In no event shall vividstratumium AG, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Our total liability to you for all damages, losses, and causes of action arising out of or relating to these Terms or your use of the Service shall not exceed the amount paid by you to vividstratumium in the twelve (12) months preceding the event giving rise to the claim.

These Terms shall be interpreted and governed by the laws of Austria, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Salzburg, Austria.

If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights as a consumer under applicable EU consumer protection laws.

Dispute Resolution

We encourage you to contact us directly to resolve any disputes. If a dispute cannot be resolved through direct negotiation, we are committed to resolving disputes through alternative dispute resolution procedures.

For EU consumers, you may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr/ to resolve disputes with us.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law.

The remaining provisions will continue in full force and effect. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder.
